Terms of Service

These Terms of Service govern your use of the Arrive platform as a host. By creating an account you accept these terms in full. Please read them carefully before registering.

1. Who we are

Kerry Lotee, trading as Arrive(“we”, “us”, “Arrive”), operates a cloud-based booking and guest-management platform accessible at arrive.co.ke.

“You” or “Host” means the individual or business entity that has created a host account on Arrive.

2. What Arrive does

Arrive gives you a public booking page, reservation management, guest communication tools, and a review-collection system. Arrive does not process payments on your behalf — all deposits and balances flow through Paystack and are collected directly by you.

Arrive does not hold, disburse, or transmit any funds belonging to you or your guests. We are not a payment service provider and are not regulated as one.

3. Eligibility and account security

To register as a host you must: (a) be at least 18 years of age; (b) have the legal right to list the accommodation you offer; (c) comply with all applicable Kenyan laws including the Tourism Act, Tourism Regulatory Authority requirements, and any county by-laws governing short-term rentals.

You are responsible for keeping your account credentials secure. You are liable for all activity that occurs under your account.

4. Listing accuracy

You warrant that all information in your listing — unit descriptions, photography, pricing, availability, and amenities — is accurate, complete, and not misleading.

Arrive may remove or suspend any listing that in our reasonable assessment contains false or misleading information, infringes third-party rights, or violates these terms.

5. Fees and billing

Arrive charges a monthly subscription fee as published on the pricing page at the time of your registration. Fees are billed in advance. We will give 30 days’ written notice before any fee change. Continued use after that date constitutes acceptance of the new fee.

All fees are exclusive of VAT. Where VAT is applicable it will be added to invoices at the prevailing statutory rate.

6. Guest data and your obligations as controller

When a guest books through your Arrive page you become the data controller of that guest’s personal data for the purpose of fulfilling the booking. Arrive processes that data on your behalf as a data processor.

You must:

  • Use guest data only to fulfil and manage bookings made through Arrive.
  • Not sell or share guest data with third parties for unrelated purposes.
  • Comply with the Kenya Data Protection Act 2019 and all applicable regulations in your handling of guest data.

7. Prohibited conduct

You must not use Arrive to:

  • List accommodation you do not have the legal right to offer.
  • Discriminate against guests on the basis of race, religion, nationality, gender, disability, or any other characteristic protected under Kenyan law.
  • Send unsolicited commercial messages to guests beyond what is necessary for booking fulfilment.
  • Direct guests to book outside the platform after initial contact made through Arrive, in order to avoid platform fees.
  • Upload content that is defamatory, obscene, fraudulent, or that infringes any intellectual property right.

8. Intellectual property

You retain ownership of the photos and text you upload to Arrive. You grant us a non-exclusive, royalty-free licence to display that content for the purpose of operating your booking page and, where applicable, marketing the Arrive platform.

Arrive retains all rights in the platform software, design, trade marks, and brand.

9. Limitation of liability

To the maximum extent permitted by Kenyan law, Arrive’s total liability to you for any claim arising from your use of the platform will not exceed the fees you paid to Arrive in the three calendar months immediately preceding the event giving rise to the claim.

Arrive is not liable for losses arising from: guest cancellations; non-payment of balances owed to you; property damage caused by guests; force majeure events; or any indirect, consequential, or pure economic losses.

10. Termination

You may close your account at any time by contacting support. On closure, your booking page will be taken offline and no new bookings will be accepted. Existing confirmed bookings remain your contractual obligation to guests.

Arrive may suspend or terminate your account immediately if you materially breach these terms or if continued operation poses a risk to guests or to platform integrity.

11. Governing law and disputes

These terms are governed by the laws of Kenya. Any dispute that cannot be resolved by negotiation within 30 days will be submitted to the jurisdiction of the Kenyan courts.

12. Changes to these terms

We may update these terms from time to time. We will notify you by email at least 14 days before a material change takes effect. Your continued use of Arrive after the notice period constitutes acceptance of the revised terms.
